Conditions of Issue and Use
You are about to apply for your MSIC through ClientView Pty Ltd and it is important
that you understand the conditions of its issue and use including:

These conditions are outlined in the Maritime Transport and Offshore Facilities
Security Regulations.
It is an offence under these regulations not to comply with the MSIC conditions of
issue and use. Offences apply and can attract substantial fines.
How to properly display your MSIC
When wearing your MSIC it must be:

Attached to your outer clothing

Worn above the waist
-
Displayed at the front or side of your body
- The whole front of the MSIC must be clearly visible

If the photograph or any other part of the MSIC is obscured, your MSIC is not properly
displayed.
You are committing an offence if your MSIC is not properly displayed in a maritime
security zone.
There are a number of methods to assist you to properly display your MSIC depending
upon the workplace you work in. Some examples include lanyards worn around the neck
or clear plastic Velcro armbands that can be worn on the outer layer of clothing.
For further advice, speak with your employer or contracting authority about the
most effective method of displaying your MSIC.
For the MSIC to be valid within a maritime security zone, the photo must be that
of the wearer. If this is not the case the MSIC is invalid and the wearer has committed
an offence. Your MSIC has been issued only to YOU. You cannot lend or give your MSIC
to any other person. If another person attempts to use your MSIC they will be committing
an offence.
Failing to properly display an MSIC can attract a fine of 5 penalty units (approximately
$550) for a first offence. Subsequent offences can attract penalties of up to 10
penalty units (approximately $1,100) for a second offence and up to 20 penalty units
(approximately $2,200) for a third offence.
When and Where to display your MSIC
You must wear your MSIC whenever you enter and remain within a maritime security
zone. If you do not properly display your MSIC at all times when in a maritime
security zone you have committed an offence.
Failing to properly display your MSIC in a maritime security zone is an offence and
can attract a fine of 5 penalty units (approximately $550) for a first offence.
Subsequent offences can attract fines of up to 10 penalty units (approximately $1,100)
for a second offence and up to 20 penalty units (approximately $2,200) for a third
offence.
You may be directed to display your MSIC to a security officer. When giving this
direction, the security officer (either a law enforcement officer or a maritime
security inspector) must present their official identification.
Failure to comply with a lawful request to display your MSIC can attract a fine of
10 penalty units (approximately $1,100).
If you encounter someone who is not displaying an MSIC in a maritime security zone
you should immediately report the event to security staff and or the facility operator.
If safe to do so, you should also challenge the person and ask them to display their
MSIC.
Maritime Security Zones
There are a number of maritime security zones across Australia where the MSIC provisions
apply. These include:

Land side restricted zones – these zones are used to provide controlled access to
landside areas
-
Cleared zones – used to facilitate the screening of persons and/ or goods that move
on and off of specific vessels

Water side restricted zones – used to provide controlled access to waterside areas
including berths, jetties and moorings

Ship security zones – used to control access around a moving security regulated
ship
-
On-Board Security zones – used to control access to areas or parts of security regulated
ships
- Offshore Security zones – used to control access around and within regulated offshore
oil or gas facilities
The Department of Transport & Regional Services (DOTARS) website contains
additional information about these zones for all ports, port facilities, security
regulated ships, and offshore oil and gas facilities.
What to do if your MSIC has expired, cancelled or damaged
You must return your MSIC to ClientView Pty Ltd by registered mail within 30 days
or less in the following circumstances:

Your MSIC has expired
-
You have been notified in writing that your MSIC has been cancelled or
- Your MISC has been damaged, altered or defaced either permanently or temporarily
Failure to return your MSIC to ClientView Pty Ltd within 30 days in these instances
can attract a fine of 10 penalty units (approximately $1,100).
What to do if you no longer have an operational need for your MSIC
You must return your MSIC to ClientView Pty Ltd by registered mail, if your
circumstances change and you no longer have an operational need to hold an MSIC.
If you do not need to enter a maritime security zone in the next 12 months, you
no longer have an operational need to hold your MSIC and it must be returned.
You have 30 days to return your MSIC to ClientView Pty Ltd from the moment
that you become aware of any such change in your circumstances.
Failure to return your MSIC to ClientView Pty Ltd in this instance is an offence
and can attract a fine of 5 penalty units (approximately $550).
What to do when your MSIC is lost, stolen or destroyed
You should keep your MSIC secure at all times, even when it is not being worn. You
must also report the loss, theft or destruction of your MSIC to ClientView Pty Ltd.
If your MSIC is lost stolen or destroyed, you must submit a statutory declaration
to ClientView Pty Ltd by registered mail within 7 days of becoming
aware of the loss, theft or destruction.
If your MSIC is stolen, you must immediately report the theft to the appropriate
State or Territory Police. A copy of the Police Report or any other information
issued by the Police must also be forwarded to ClientView Pty Ltd by registered mail
within 7 days of becoming aware of the theft.
ClientView Pty Ltd will replace your lost, stolen or damaged MSIC for a fee. You
may have to apply for a temporary MSIC while your application for MSIC renewal is
being progressed. A temporary MSIC may be available from the relevant maritime security
plan, ship security plan or offshore oil or gas facility security plan holder e.g.
Port Operator or Port Facility Operator.
Failure to report the loss, theft or destruction of an MSIC to ClientView Pty Ltd
can attract a fine of 10 penalty units (approximately $1,100).
What to do if you legally change your name
If you change your name, you must provide written evidence of your name change
to ClientView Pty Ltd by registered mail. When you change your name you must
replace your MSIC.
You have 30 days to return your original MSIC to ClientView Pty Ltd for destruction
following receiving your replacement MSIC.
Replacing your MSIC
Your MSIC may be replaced by ClientView Pty Ltd if:

It has been lost, stolen or destroyed and you have properly reported the event

The MSIC requires renewal (the MSIC is within 6 months of the expiry date and you
still have an operational need to maintain the MSIC)
- You have changed your name and have provided appropriate written evidence of your
name change to ClientView Pty Ltd by registered mail.
The replacement MSIC will be the same cost as the original MSIC and will have the
same expiry date as the original it replaces.
Responsibilities of monitoring or escorting visitors
A person who requires entry to a maritime security zone and who does not hold an
MSIC will be treated as a visitor. All visitors must be monitored or escorted whilst
they are in a maritime security zone by a valid MSIC holder. Access and visitor
procedures will vary according different maritime security zones and will be explained
at site inductions.
As a valid MSIC holder, you may be asked to continuously monitor or escort a visitor.
This should be undertaken in accordance with the procedures set out in the relevant
maritime security plan, ship security plan or offshore oil or gas facility security
plan and relevant site induction.
Failure to properly monitor or escort a visitor is an offence and can attract a fine
of 5 penalty units (approximately $550).
